It is highly likely that most all of us have used this term in some fashion or another. What is interesting about this term is that it is not a mental disorder, it is a legal term that is used in the court system to describe a defendant in a trail. The second example that involves bravery that I chose has to deal with the people that were willing to follow their leaders into battle. It takes a brave individual to go into battle knowing that their either out numbered or that they are completely outmatched. In Beowulf their was a group of warriors from Geatland that followed Beowulf on his adventures and helped him get out of different situations . One of the notable situations i recall is when Beowulf and his men are in Heorot Hall and Grendel shows up to kill. The men are scared and some start to get killed but they show bravery by standing by Beowulfs side whenever he tries and attacks and eventually takes down Grendel. In the Battle of Maldon a similar situation occurs when the Vikings start to come on shore. Byrhtnoth ordered his men to line up at the shore line in order to hinder the Vikings from coming on shore. This is a brave and risky task because the Vikings are using spears and arrows so they wont have to get very close to hurt them. The fact that the men took those orders without hesitation shows that have a high quality trait in bravery, and they trust their leader in this tough situation. The third example that I felt belonged in this discussion was what some of the men did after their leader died. In the end of Beowulf there is a great dragon that starts terrorizing Geatland because of a disturbance in his lair. Before Beowulf goes and tries to kill the dragon, he goes and gathers eleven of his best men from Geatland. Before they leave Beowulf informs his men that it is an extremely big chance that he might die. Once they get to the dragons lair Beowulf goes to face the dragon by himself and ends up dying from a bite from the dragon. When this happens ten of the eleven men decide to act cowardly and run away from the fight, but one man named Wiglaf stays and fights the dragon by his lonesome and ends up killing the dragon. This act that Wiglaf does one of the bravest and loyal things an individual can do in that situation. Wigalf could have run away with the rest of the men but he decided to stay and show honor and bravery by killing the dragon after it killed his leader. In the Battle of Maldon the same thing basically happened when their leader Byrhtnoth went down. As the tides started to shift in battle when Olaf’s men started getting on shore and some of Byrhtnoth men decided to flee. When a small group of his men decided to retreat more and more followed because they thought that was the signal to retreat but it really wasn’t. It also goes along with my second example but this theme shows more bravery, courageousness and more honor because they are fighting for their fallen leader. It takes a strong willed and an extremely brave individual to stay and fight when their leader and strongest person has fallen and there is now no one there to give them orders in battle. Grendel’s mother would already be hard enough to fight alone, but add on the fact that its under water and add the fact that none of Beowulf’s weapons work on Grendel’s mother shows that Beowulf is an extremely daring individual and that he really isn’t scared in any situation. I see myself as a tender and loving grandmother, full of optimism and respect towards innovation and progress. I will cherish warm relations with all of my family members, old friends and other relatives. I do not imagine my life without close people, especially at the end of the life, human relations become more specific and as all elder people, I too, will greatly depend upon positive relations. Maintenance of friendly and loving atmosphere around me will be my main goal. I would dream to be in good health and good shape but for 72 years old person being able to take care of myself, to be able to move, to see and hear, do not have chronic serious illnesses is a positive perspective. From now on I foresee that I might have problems with my backbone and probably have blood pressure problems. The world is inhabited by numerous cultures consisting of different lifestyles. Freeganism is a subculture that is ordinarily unheard of. The characteristics are impressively diverse from those most would associate with everyday life. The capitalistic culture incorporates commodified food, organized structure, ‘hygienically clean’, easier accessible foods, and more individualization. On the other hand, a freegan culture is comprised of free food, a less organized structure, ‘dirty’ foods with a chance of being raw or rotten, slower food and lifestyle, and is more socially connected (Edwards and Mercer). Those living this standard of life are scavengers of the developed world, living off consumer waste in an effort to minimize their support of corporations and their impact on the planet. Grace Hutchins, a passionate supporter of this form of life, depicts it as dumpster diving to use resources that would go to waste, voluntary work that includes sharing huma n resources, such as time and skills, and finding ways to limit consumption and materialism in our own lives and those of others. A variety of reasons people choose to participate in the freegan lifestyle are more diverse than one would think. Legality and Ethicality of Financial Reporting Essay

As the case of Excello Telecommunications is reviewed it can be seen that the CFO was facing financial difficulties due to increased competition. In 2010 the earnings estimate was not going to be met and this would have affected the bonuses, stock options, and the share prices of the Excello stocks. After discovering a large sale that was pending until the shipment could be made for the following year the CFO asked the company controller to find a way to capitalize on the sale in the current year so that the budget shortfall could be met. The only way to accomplish the task was to work around the rules of accounting. The intent to find a way around the rules presents possible legal issues. This case can be evaluated by the Sarbanes-Oxley Act and the AICPA and we look at the financial reporting standards and ethics involved. The CFO of Excello, Terry Reed, discovered that the company made a sale of $1.2 million dollars on December 20, 2010 but it could not be recorded until January 11, 2011 because the purchasing company’s warehouse capacity could not accommodate the equipment. After this discovery Reed determined that the monetary shortfall for 2010 could be solved if the company could record the sale for 2010 instead of in 2011. The Controller, Marty Fuller, for the company approached the accounting department and there were three possible ways found to work around the dilemma. The first was to transfer the product to an off-site warehouse that was owned by Excello by December 31 and hold it there until January 11 when it could be shipped to the purchaser. The second would be to transfer the product to the purchaser by December 31 and offer a full refund upon return. The third option is to offer a ten percent discount to the purchaser if they accept the product by December 31. In reviewing this case it can be seen that there are legal issues that are involved. The controller of the company is fully aware of the rules of accounting and is willing to work around them at the request of the CFO practicing earning management in an effort to achieve the company financial goal. Excello cannot legally report the income of the $1.2 million dollar sale in 2010 due to the fact that it will not be shipped until 2011. If the sale is recorded the way the CFO wants it to appear the company would be artificially inflating the profits for the year 2010. If the sale is recorded in 2010 it will be overstated earnings and will violate the GAAP for revenue recognition. The revenue recognition rule is stated so that the goods are to be delivered to the buyer before  revenue can be recorded. Falsely reporting this will artificially inflate the revenue and is deceiving to the shareholders. The Sarbanes-Oxley Act (SOX) was designed so that it could regulate the rules and regulat ions and appropriately guide companies in reporting their financial statements and performing audits. The CFO for Excello decided to use earning management practices and falsely inflate the financial statement from 2010 in order to meet the earnings estimate it and in doing so breached Section 302 of the SOX codes. Section 302 of the SOX is the Corporate Responsibility for Financial Reports and states â€Å"This section requires the certification of periodic reports filed with the SEC by the CEO and CFO of public companies. (Mintz & Morris, 2011)† The reports that will be filed by Excello for the 2010 year with the SEC will contain false information and in doing so will violate the code. The goal of the SEC is to protect activities and interests of investors, lenders, and companies. The artificial inflation for earned revenue in 2010 by Excello causes risks to the investors, lenders, and shareholders as it is fraudulent information that is reported and is an unethical practice. The unethical financial reporting that Excello considered in this case goes against the AICPA Code o f Professional Conduct. The AICPA holds Certified Professional Accountants to a high ethical standard. As the Excello Company reports revenue prematurely it violates several of the principles that the AICPA is built on. The reasoning of the decision to prematurely record $1.2 million dollars was based on bonuses, stock, and shareholders and was not done in the interest of the public. This decision could have affected the integrity of the company as the trust to the public, clients, and lenders would be broken. The decision to artificially inflate the profits for the year 2010 proves to be unethical in the terms of the AICPA. Putting the bonuses, stock options, and the share prices ahead of the public interest is unethical behavior and unaccepted by the AICPA, GAAP, or SEC. The accounting department for Excello came up with three ways that the rules of the GAAP could be bent in order to accommodate recording profits earlier than appropriate. The first was to ship to an offsite warehouse owned by Excello by D ecember 31, 2010 and ship it again on the requested January 11, 2011 date. The second was to transfer the product to the buyer by December 31 and offer a full refund if retuned to Excello. The third option was to offer the buyer a ten percent discount to take the  product by December 31, 2010. Of the three options the best alternative seems to be offering a discount if the customer takes the product by December 31, 2010. Giving discounts to a buyer is not an uncommon practice and is not an illegal practice that is defined by the GAAP or the SEC. If the product is delivered to the buyer by the December 31, 2010 deadline the sale will be legitimate and the $1.2 million dollars can be appropriately recorded in 2010. Transferring the product to the buyer before January in order to make the earnings estimate and procure the bonuses and stock options is not the most ethical reason but does not appear to be illegal. The CFO of the company asked the controller to find a way around the GAAP regulations in order to record a large sale by the end of the 2010 year that would have been otherwise legally recorded in 2011. After reviewing the GAAP regulations it is seen that recording a sale before the buyer takes ownership is a fraudulent recognition of profit. The process of recording and recognizing revenue before it is actually due is illegal in the eyes of the SEC. This artificial inflation of profits can affect the public and investors in the company. The unethical behavior of fraudulent profit recording goes against the AICPA Code of Professional Conduct as well because it puts the company ahead of the public interest. There were three options given by the accounting department to solve the issue of the year-end profit earnings. Of the three options presented, the third was to offer a discount in order for the customer to take delivery of the product by the deadline allowing for profits to be recorded legally. It is understandable that a company needs to make the earnings estimate, however it should be done legally and no CFO or CPA should consider bending the rules set forth by the GAAP. The story teaches us how the Chinese views the aspects of loyalty, responsibility, spirituality, and many other aspects about the Chinese culture. Since the monkey was still behaving wildly even though he is freed, the monk had put a headband spell that would contract each time the monkey would act in an undisciplined manner. There are thousands of characters and strange tones! It must surely be impossible to learn for an adult foreigner! You can learn Mandarin ChineseThats nonsense of course. Naturally, if youre aiming for a very high level, it will take time, but I have met many learners who have studied for just a few months (albeit very diligently), and have been able to converse rather freely in Mandarin after that time. Continue such a project for a year and you will probably reach what most people would call fluent. So definitely not impossible. How difficult a language is depends on many things, but your attitude is certainly one of them and its also the easiest one to influence. You stand little chance of changing the Chinese writing system, but you can change your attitude towards it. In this article, Im going to show you certain aspects of the Chinese language and explain why they make learning a lot easier than you might think. How difficult is it to learn Mandarin Chinese? Of course, there are also things that make learning Chinese harder than you think (or perhaps as hard), sometimes even the same things from different angles or on different proficiency levels. That, however, is not the focus of this article. This article focuses on the easy things and is meant to encourage you. For a more pessimistic outlook, Ive written a twin article with the title: Why Mandarin Chinese is harder than you think. If you already study Chinese and want to know why its not always easy, perhaps that article will provide some insights, but below, I will focus on the easy things. Difficult or easy for whom? With what goal? Before we talk about specific factors that make learning Mandarin easier than you might think, Im going to make some assumptions. You are a native speaker of English or some other non-tonal language not related to Chinese at all (which would be most languages in the west). You might not have learnt any other foreign language, or perhaps youve studied one in school.   If your native language is related to Chinese or is influenced by it (such as Japanese, which largely uses the same characters), learning Chinese will become even easier, but what I say below will be true in any case. Coming from other tonal languages makes it easier to understand what tones are, but its not always easier to learn them in Mandarin (different tones). I discuss the downsides of learning a language completely unrelated to your native language in the other article. Furthermore,  Im talking about aiming for a basic level of conversational fluency where you can talk about everyday topics youre familiar with and understand what people say about these things if targeted at you. Approaching advanced or even near-native levels requires a whole new level of commitment and other factors play a bigger role. Including the written language also adds another dimension. Why Mandarin Chinese is easier than you think Without further ado, lets get into the list: No verb conjugations - Partly because of bad teaching practice, many people associate second language learning with endless verb conjugations. When you learn Spanish or French and care about being accurate, you need to remember how the verb changes with the subject. We have this in English too, but its much easier. We doesnt say we has. In Chinese, there are no verb inflections at all. There are some particles that change the function of verbs, but there are certainly no long lists of verb forms you need to memorise. If you know how to say çÅ"‹ (kn) look, you can use it for any person referring to any period of time and it will still look the same. Easy! No grammatical cases - In English, we make a difference between how pronouns are handled depending on if they are the subject or the object of a sentence. We say he talks to her; him talks to she is wrong. In some other languages, you need to keep track of different objects and sometimes also not only for pronouns, but for nouns as well. None of that in Chinese! 我 (wÇ’) I, me is used in any situation referring to myself in any way. The only exception would be plural we, which has an extra suffix. Easy!   Flexible parts of speech - When learning most languages other than Chinese, you need to remember different forms of the words depending on what part of speech they belong to. For example, in English we say ice (noun), icy (adjective) and to ice (over)/freeze (verb). These look different. In Chinese, though, these could all be represented by one single verb å† ° (bÄ «ng), which incorporates the meaning of all three. You dont know which one it is unless you know the context. This means that speaking and writing becomes much easier since you dont need to remember so many different forms. Easy! No gender - When you learn French, you need to remember if each noun is meant to be le or la; when learning German, you have der, die and das. Chinese has no (grammatical) gender. In spoken Mandarin, you dont even need to make a difference between he, she and it because they are all pronounced the same.  Easy!  Relatively easy word order -  Word order in Chinese can be very tricky, but this mostly becomes apparent at more advanced levels. As a beginner, there are a few patterns you need to learn, and once youve done that, you can just fill in the words youve learnt and people will be able to understand. Even if you mix things up, people will usually still understand, provided that the message you want to convey is relatively simple. It helps that the basic word order is the same as in English, i.e. Subject-Verb-Object (I love you). Easy! Logical number system - Some languages have really bizarre ways of counting. In French, 99 is said as 4 20 19, in Danish 70 is half fourth, but 90 is half fifth. Chinese is really simple. 11 is 10 1, 250 is 2 100 5 10 and 9490 is 9 1000 400 9 10. Numbers do get a little bit harder above that because a new word is used for every four zeroes, not every three as in English, but its still not hard to learn to count. Easy!Logic character and word creation - When you learn words in European languages, you can sometimes see the word roots if youre good at Greek or Latin, but if you take a random sentence (such as this one), you cant really expect to understand how each word is constructed. In Chinese, you actually can do that. This has some significant advantages. Lets look at a few examples of advanced vocabulary that are really easy to learn in Chinese but very hard in English. Leukemia in Chinese is è ¡â‚¬Ã§â„¢Å' blood cancer. Affricate is Ã¥ ¡Å¾Ã¦â€œ ¦Ã©Å¸ ³ stop friction sound (this r efers to sounds like ch in church, which has a stop (a t sound), then friction (the sh sound)). If you didnt know what these words meant in English, you probably do now after looking at a literal translation of the Chinese words! These are not exceptions in Chinese, this is the norm. Easy! These are just some of the more obvious reasons that reaching a basic level in Chinese is not as difficult as you think. Another reason is that Chinese is much more hackable than any other language Ive learnt. The difficult parts are easier to hack What do I mean by this? Hacking in this case means understanding how the language works and using that knowledge to create smart ways of learning (this is what my website Hacking Chinese is about). This is especially true for the writing system. If you approach learning Chinese characters like you would learning words in French, the task is daunting. Sure, French words do have prefixes, suffixes and so on and if your Latin and Greek are up to par, you might be able to use this knowledge to your advantage and be able to understand how modern words are created. For the average learner, however, thats not possible. Its also the case that many words in French (or English or many other modern languages) cant be broken down or understood without doing serious research into etymology first. You can of course break them down yourself in ways that make sense to you. In Chinese, however, you dont need to do that! The reason is that one Chinese syllable corresponds to one Chinese character. That gives very little room for change, meaning that while words in English can gradually lose their spelling and morph over the centuries, Chinese characters are much more permanent. They do of course change, but not that much. It also means that the parts that make up the characters are in most cases still present and can be understood on their own, thus making understanding a lot easier. What all this boils down to is that learning Chinese neednt be all that hard. Yes, reaching an advanced level takes a lot of time and effort, but getting to basic conversational fluency is within reach for all those who really want it. Will it take longer than reaching the same level in Spanish? Probably, but not that much if we only talk about the spoken language. After Annas death, Brian thinks about how the brightness of a star can overshadow another star, and when the other star is seen, it is too late. This applies to how Kate overshadowed Anna, and when Anna finally asserts herself, she dies. After Annas death, Kate reveals that her father said he could see Anna reincarnated in the stars. Roles The characters in the book play different roles. Anna is in the donor role for her sister when she would rather be in the role of a teenager who has friends and plays hockey. The lawsuit is Annas way of resisting her lifelong role. Throughout the book, she imagines herself in outlandish adventure roles, and after winning the hearing, Campbell thinks she will have fantastic roles in 10 years. Jesse changes roles by the end of the book. At first, he does not see himself as a rescuer because he cannot rescue Kate. After he has a breakthrough with his father, he goes from arsonist to police officer or savior. Sara and Brians roles go beyond being parents. Sara wants to play the savior role for Kate, but she has to get Anna to play that role. She demonstrates that she expects sisters to help each other as her sister, Suzanne, helps her. Sara has conflicts with the mother/lawyer role. After the lawsuit begins, Sara tries to balance being a mother to Anna and a lawyer on the opposing side of the lawsuit. This is a constant struggle until Sara realizes she is a good mother, and she should not try to save her children from themselves. Brian is the savior and mediator as he tries to save everybody in the family and acts as a buffer between Anna and Sara. Campbell has the lawyer role as he panders to the media and questions the witnesses at the hearing. He could be seen in a rescuer role as he rescues Anna from donating to Kate. He also has the romantic role with Julia, but this does not come to fruition until the end of the book after his secret is revealed. Julia has a mediator role as Annas guardian ad litem and a romantic role with Campbell after she learns the truth. Julias role as a sister is shown with her twin, Isobel. Ethical Dilemmas At the heart of My Sisters Keeper is an ethical dilemma: Should thirteen-year-old Anna be forced to give her kidney to her dying sister? Through much of the novel, it seems like Anna does not want to give Kate her kidney because she is tired of being a store of spare parts for Kate. Since she was born, Anna has undergone a number of painful procedures to save Kates life. Kate suffers from cancer and conditions related to the illness and its treatment. Her familys life has been focused on Kates illness and its potential recurrence during times of remission, since before Anna was born. Indeed, Anna was created to be a perfect sibling match for Kate. The Fitzgeralds went to a geneticist who created several embryos with the couples sperm and eggs, then figured out which one matched Kate. That embryo was implanted in Sara and became Anna. At the time, there was public controversy over their decision because Anna was seen as a designer baby. The ethical debate led to a talk show appearance for the couple, as well as hate mail. More than anyone else in the family, Sara sees no ethical dilemmas, neither in how Anna was created nor in making Anna suffer to try to keep Kate alive. Sara only responds to the latest crisis and the best solution at hand. When necessary, taking from Anna to give to Kate is no dilemma for her. The result is that Kate has lived longer than her doctor ever expected, but at the cost of a balanced family. The needs of Kate and her illness are put above all else, with Sara diligently guarding those interests at the expense of her husband and other children. Even Julia, the court-appointed guardian of Annas interests, cannot make a decision on what should be done. Annas lawsuit brings all these issues and the ethical dilemma to the forefront. With Campbell acting as her lawyer, she seeks the right to decide whether she gives up a kidney. Annas true motivation in her quest for medical emancipation is yet another ethical dilemma. As she reveals on the stand during the hearing, the reason that Anna has brought the lawsuit was for Kates benefit. Kate cannot tell her mother that she does not want to have the transplant. Kate is aware of the toll her illness has had on everyone and she seems tired of fighting. In fact, she has tried to kill herself before. This situation brings up the ethical dilemma: Should Kate be allowed to die when a measure can be taken to save her life? None of these ethical dilemmas is allowed to reach its full conclusion in the story. The novel ends with Anna suffering an injury that leads to brain death. He loves his sisters and has done what he can to keep Kate alive, most notably giving his blood regularly to boost her platelets. But he has also moved into an apartment over the family garage to be separate from, yet still part of, his family. He sets fires to get attention and to feel a sense of control over something. Jesse knows the fires, car theft, and substance abuse are all masks for his pain, but he needs a parent to care about him. Campbells secret is revealed there, and the truth behind the lawsuit is also revealed there. Some settings serve as places that save the characters. The hospital obviously saves Kates life. The fire station saves Brian and Anna. The courthouse saves the Fitzgerald family and Campbell and Julias relationship. Language and Meaning At the beginning of each section, the language of passages from famous works refer to the books situations and themes. Annas first memory storys language sets the tone for the rest of the book. The language in the main part of the book is simple, but medical terms are used often. They are well explained. Sara, Kate, and Anna have as much medical knowledge about Kates condition as anyone else. Sara uses medical language to try to save Kate. Kate uses it, along with the language of a frustrated teenager, who is concerned about appearance and dating. Anna also mixes it with her own concerns about her life outside Kate. Legal language is used in the petition and in the hearing. The medical language helps Kate, but the legal language helps Anna. Sara analyzes words as she ponders situations. For example, she talks about how there is no word for a parent whose child dies. (703) Anna tries to figure out language, too. Brian and Anna use the language of astronomy and legends in an attempt to figure the world out. Brian uses his firefighter language to demonstrate situations. There is a combination of characters thoughts and dialogue. Because of his medical knowledge as a rescue worker, Brians thoughts let the reader know what is wrong with Campbell. Julias language with the Fitzgeralds is that of the mediator, which is part of her role as guardian ad litem even though she is not as conciliatory toward Campbell. The characters thoughts allow the readers to understand them; their dialogue does not sufficiently describe the characters. For example, Annas thoughts reveal her maturity beyond her 13 years. Jesse projects a tough-guy image to everyone with crude language, but his thoughts reveal his softer feelings about his family. Campbell is similar in that he acts like the tough lawyer, but his flashbacks to Julia and his present-day thoughts unveil his romantic side. Getting ready for the last day of the trial, Campbell, Brian, Jesse, Anna, and Sara note that it is raining at the beginnings of their chapters. These words quench the fires that have been raging in the book. Structure The chapters are not numbered. They are titled by the characters names. There is a prologue with a quote and then a short story by Anna. The sections are started by a day of the week and a passage. Saras chapters are flashbacks titled by years until her chapter called Present Day where she joins the present. She begins with Kates diagnosis and goes through the milestones of Kates illness. Campbell and Julias chapters are in the present, but they have flashbacks to their time together in high school. There is an epilogue by Kate set in a time in the future. The plot zigzags back and forth between the present and the past; it depends on the speaker. The book chronicles the events of the Fitzgerald family out of order mainly after Kates diagnosis: Annas birth; Annas donations; Anna, Kate, and Jesses childhoods; and the hearing and its aftermath. Campbell and Julias professional and personal stories and sections of the past about their teen relationship are mixed in. Multiple Points of View One striking feature of My Sisters Keeper is the way Picoult uses multiple first-person narrators to tell the story. A first-person point of view tells the story from one characters perspective in his or her own voice. Each section in the novel is made up of parts designated by the name of the character whose voice and perspective is being revealed. Picoult emphasizes the differences in these voices through the use of different fonts for different characters. The use of multiple voices allows readers the ability to understand the situations from different standpoints. The way Sara sees Kates cancer and Annas lawsuit is quite different from Annas viewpoint, Jesses position, and Campbells and Julias judgment. The result is a rounded, dramatic narrative. Flashback/flash-forward Several characters use flashbacks and flash-forwards as part of their narratives. Flashbacks look back in time, while flash-forwards describe future events. The only major character in the book who does not get a voice in the main chapters is Kate. She speaks only in the prologue and epilogue, eight years after the novels end. In the prologue, she talks about how she imagined killing her sister and that she only existed i
